Former MUBS Principal Balunywa Granted Bail in Abuse of Office Case

The Anti Corruption Court has granted bail to former Makerere University Business School (MUBS) Principal, Prof. Waswa Balunywa, in two separate abuse of office cases. The decision was delivered on Friday, 5th September, 2025.

Balunywa, 69, who led MUBS for over two decades before retiring in 2022, was remanded to Luzira Prison on Tuesday, 2nd September, 2025 over allegations that he hired unqualified staff.

He was released on cash bails of UGX 10 million and UGX 5 million, while his sureties were bonded at Shs100 million and  UGX 50 million, respectively.

Court documents indicate that between February and April 2023, Balunywa recruited three administrative assistants namely; Arike James, Nuwagira Nathan, and Nimrod Kakayi despite knowing they did not meet the minimum academic qualifications.

Prosecutors say this created ineligible costs for the Government of Uganda. He faces three counts of abuse of office under Section 10(1) of the Anti-Corruption Act.

Balunywa’s legal team, led by Asuman Matovu, argued for bail on several grounds, that he has a permanent place of residence, is of advanced age, voluntarily appeared when summoned, and had submitted his passport and land title to the court as additional security.

Chief Magistrate Racheal Nakyazze granted bail, directing that Balunywa’s passport remain in court custody and his land title be retained as security.

“Bail is a constitutional right, and the discretion lies with the judicial officer. The sureties presented are substantial and capable of ensuring the applicant’s attendance,” Chief Magistrate Nakyazze said.

The magistrate also dismissed an objection by the Director of Public Prosecutions (DPP) on jurisdiction, confirming that the Anti Corruption Court has nationwide authority to hear cases across Uganda.

The court scheduled 18th October, 2025 for mention and pre trial proceedings in both cases.

The allegations against Balunywa form part of ongoing efforts to tackle abuse of office in public institutions.
