The military court marital has sent Private Herbertson Robert Birivumbuka, a soldier attached to the Special Forces Command (SFC), on the death penalty after losing the case of killing five people from the same home in Mayuge district.

Lt Col Moses Nabasa, who presided over the court that sat in Mayuge district on Thursday, October 31, 2024, sent Birivumbuka to the death penalty after he pleaded guilty to the charges of murder of five people whom he found in the house of Isaac Isabirye Mudhasi in June 2024.

According to the documents in court, Birivumbuka agreed to killing the five people after having a land disagreement.

“The focus in this court considered the four-month period Herbertson spent on remand, up to custody. This court therefore sentences you RA250302 private Birivumbuka Robert Herbertson to death in respect to count one; the punishment you receive is death in case no. 1,” Lt Col Nabasa said.

The 28-year-old soldier opened fire on the family and claimed the lives of his uncle Isaac Mudhasi Buyinza and his children Elesi Kafuko, Resty Kantono, and Nicholas Musasizi, while Jesca Timujibwa, Viola Kyakueaire, Ham Kitiibwa, and Maureen were injured.

Birivumbuka, commonly known as “Kaaba,” faced 10 charges, including murder, attempted murder, and conspiracy to commit a felony.

Following his conviction, Birivumbuka received several sentences, including death for the first count of murder, 90 years in prison for the second, life imprisonment for the third, 54 years for the fourth, and 52 years for the fifth.

Birivumbuka was further sentenced to 25 years for counts six, seven, and eight, 20 years for count nine, and three years for conspiracy charges, all of which will be served in Luzira Maximum Prison.

Additionally, Birivumbuka’s father, Patrick Tagaba, was sentenced to one year in prison, while Med Mumbya received six months in Kirinya Prison.

Lt Col Nabasa said that the punishment to Birivumbuka should be a lesson to all soldiers and that it should prevent other soldiers from doing the same.

Other counsels in attendance during the prosecution were Lt Hirald Rugyendo as the defense counsel, Lt David Basiima as prosecutor, and Hasan Yakubu Mulyanti as judge advocate.
