Kivumbi’s Bail Bid Deferred as Terrorism Case Hearing Ends Without Ruling

Court hears arguments from prosecution and defence as NUP vice president and 23 co-accused remain on remand pending a decision on their bail application.

The bail application hearing for former Butambala County Member of Parliament Muhammad Muwanga Kivumbi and 23 co-accused ended without a ruling on Monday, leaving the group on remand as they continue to face terrorism-related charges before the International Crimes Division of the High Court.

Kivumbi, who also serves as the National Unity Platform (NUP) Vice President for the Buganda region, appeared before Justice Susan Okalany alongside his co-accused at the court’s premises in Kampala.

The group is charged under the Anti-Terrorism Act in connection with alleged acts of violence that followed the January 15, 2026 General Elections in Butambala District. Prosecutors allege that attacks targeted a police station and an election tally centre during the unrest.

Proceedings were marked by spirited legal arguments as defence lawyers pressed for the release of their clients despite the reported absence of some state prosecutors, who were said to be attending an official symposium.

The prosecution opposed the bail application, arguing that investigations into the matter are still ongoing and expressing concerns that the accused persons could interfere with inquiries if released.

Defence lawyers, however, urged the court to grant bail, citing the period already spent on remand and other factors they said justified temporary release pending the hearing and determination of the case.

After hearing submissions from both sides, Justice Okalany did not immediately rule on the application, instead reserving her decision for a later date.

The court also agreed with parties to limit the number of individuals attending the proceedings, a move aimed at maintaining security and order during the high-profile case.

The charges stem from post-election clashes in Butambala District that reportedly resulted in multiple deaths, although the exact number of casualties remains disputed by the prosecution and defence.

Kivumbi and his co-accused have consistently denied wrongdoing.

The case remains active, with a ruling on the bail application expected in the coming days. Meanwhile, related proceedings are scheduled to continue before the Butambala Chief Magistrate’s Court.
