City lawyer, Erias Lukwago, representing Dr Kizza Besigye in his ongoing treason trial, has once again strongly criticized the prosecution for trying to undermine the right to a fair and timely trial.
During a heated session at the Nakawa Chief Magistrate’s court, today, April 30, 2025, Lukwago accused the prosecution for deliberately obstructing the legal process.
“The prosecution has had more than enough time to act; yet they continue to delay crucial steps and hinder the swift resolution of this case. This is not only a violation of the accused’s rights but also a clear attempt to wear down their resolve,” Lukwago said.
Lukwago’s comments were directed primarily at the prosecution’s mishandling of critical evidence.
He argued that the state had possessed the accused’s phones since November 2024, yet they had only sought permission to access them months later, in March 2025.
The delay, Lukwago stated, was an unjustifiable and strategic attempt to frustrate the progress of the case.
“The accused are eager for a swift resolution. They should not be punished for the inaction of the prosecution. This is a clear case of justice delayed, justice denied,” Lukwago stated.
His remarks came after the Chief State Attorney, Richard Birivumbuka, voiced frustration over the defense’s handling of procedural matters.
Besigye and co-accused Lutale, continue to face treason and misprision of treason for allegedly plotting to overthrow the government through cross-border activities (2023–2024).
Their latest application follows the High Court’s earlier decision on April 15, in which Justice Rosette Comfort Kania denied them bail. The court cited ongoing prosecution investigations, including efforts to access Besigye’s phone data, as justification for further remand.
